Do we torture?

Is freezing people torture? Is sticking a thermometer up their rectum to ensure their body temperature doesn't dip below 25 degrees Fahrenheit (which would lead to hypothermia and death) really torture? As long as you don't kill people, could you really think of it as legal and therefore, not torture?
